01
Acceptance of these Terms
These Terms of Service (“Terms”) are a binding agreement between you (“Customer,” “you”) and Evolve (“Evolve,” “we,” “us”), a Canadian-founded research-chemical supplier operating an internationally-hosted online store.
By accessing the Evolve website (the “Site”), creating an account, or placing an order, Customer acknowledges that they have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, do not use the Site and do not purchase any product.
02
Eligibility and Age
You must be at least eighteen (18) years of age and of legal majority in your jurisdiction of residence to purchase any product offered on the Site. Some jurisdictions set the age of majority at 19; if your jurisdiction does so (e.g., British Columbia, Nova Scotia, New Brunswick, Newfoundland and Labrador, Yukon, Northwest Territories, Nunavut), the higher age applies to you.
Customer acknowledges that they meet the applicable minimum age requirement and that any misrepresentation of age constitutes a material breach of these Terms and voids any obligation of Evolve to honour a purchase, refund, or warranty.
03
Research Use Only — The Core Restriction
All peptides, compounds, blends, kits, and accessories sold on the Site (the “Products”) are sold and supplied exclusively for laboratory research use, in vitro investigation, and analytical reference purposes.
Customer expressly acknowledges and agrees that:
- Products are NOT drugs, medicines, dietary supplements, cosmetics, or food.
- Products are NOT intended for, marketed for, or approved for human consumption, human application, injection, ingestion, inhalation, or topical use on humans or animals.
- Products are NOT authorized by Health Canada, the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), or any other regulatory authority for therapeutic, prophylactic, diagnostic, or veterinary use.
- Evolve has made no representation that any Product treats, cures, prevents, mitigates, or diagnoses any disease, injury, or medical condition.
- Customer assumes full and exclusive responsibility for the use, handling, storage, disposal, and any application of the Products.
Customer further acknowledges that any use of the Products outside qualified research and analytical contexts is unauthorized, unsupported by Evolve, and contrary to these Terms.
04
Customer Responsibilities and Representations
By placing an order, Customer represents and warrants that:
- They are a qualified researcher, an employee of a qualified research entity, or are otherwise lawfully entitled to purchase research chemicals in their jurisdiction.
- They will use the Products solely for purposes consistent with Section 3.
- They will not resell, redistribute, or transfer the Products to any third party who has not agreed to the same restrictions.
- They will comply with all applicable federal, provincial, state, territorial, and local laws and regulations governing import, possession, handling, storage, and disposal of research chemicals.
- They will independently verify the legality of importing the Products into their jurisdiction prior to purchase (see Shipping Policy).
- They are not located in, and will not have the Products shipped to, any jurisdiction in which the sale or importation of the Products is prohibited.
- They are not a competitor purchasing for the purpose of reverse-engineering, counterfeiting, or competitive intelligence.
05
No Medical, Veterinary, or Professional Advice
The Site and any associated content — including blog posts, lead magnets, founder commentary, Certificates of Analysis, protocol guides, podcast appearances, and community discussions — are provided for informational and educational purposes only.
Nothing on the Site constitutes medical advice, veterinary advice, pharmaceutical advice, nutritional advice, legal advice, or professional advice of any kind. Evolve is not your doctor, your pharmacist, your naturopath, your veterinarian, or your lawyer. If you have any health concern, consult a licensed medical professional in your jurisdiction before making any decision that affects your health.
06
Product Information, COAs, and Accuracy
Evolve publishes Certificates of Analysis (“COAs”) for each manufactured batch. COAs are produced by independent third-party laboratories and represent the lab’s findings at the time of testing. Evolve strives for accuracy in product descriptions, COA links, weights, concentrations, and stated purity but does not warrant that all descriptions are free from typographical error or omission. Evolve reserves the right to correct errors and to refuse, cancel, or refund orders placed on the basis of an obvious error.
07
Orders, Pricing, and Payment
All prices are denominated in Canadian Dollars (CAD) unless otherwise stated. Pricing is subject to change without notice. An order is not accepted until Evolve issues a confirmation email; Evolve reserves the right to refuse, limit, or cancel any order at its sole discretion, including (without limitation) orders that appear fraudulent, that originate from blocked jurisdictions, or that exceed reasonable research quantities.
Payment methods accepted at checkout include credit card (via the Site’s payment processor), cryptocurrency via a third-party processor, and any other method displayed at checkout. By submitting payment information, Customer authorizes Evolve and its processors to charge the stated amount.
08
Shipping, Title, and Risk of Loss
Title to and risk of loss for the Products pass to Customer upon delivery to the carrier nominated by Evolve at the point of dispatch from the fulfilment facility. See the Shipping Policy for additional terms.
09
Returns, Refunds, and Reships
See the Refund Policy. Customer acknowledges that, because Products are perishable biological reference materials, no returns are accepted on opened Product, and refund/reship windows are limited.
10
Intellectual Property
The Site, the Evolve name, the Evolve logo, the tagline “AI-augmented longevity research platform,” all product names (including but not limited to “Wolverine Stack” and “Lean Protocol”), all written content, photography, video, COA layouts, and protocol-guide formatting are the intellectual property of Evolve or its licensors, protected by Canadian and international copyright, trademark, and trade-dress laws.
Customer is granted a limited, revocable, non-exclusive, non-transferable licence to view and access Site content for personal, non-commercial use. Customer acknowledges that they may not reproduce, scrape, mirror, repost, or commercially exploit Site content without express written permission.
11
User Conduct
Customer agrees not to:
- Use the Site or Products for any unlawful purpose.
- Misrepresent identity, age, or jurisdiction.
- Submit false COAs or fabricate test results purportedly issued by Evolve.
- Attempt to bypass age-gate, research-use attestation, or jurisdictional blocks.
- Attempt to interfere with the Site's security or availability.
- Use the Site to harass, defame, or threaten Evolve personnel, including the named founder.
12
Limitation of Liability
To the maximum extent permitted by applicable law:
- Evolve and its officers, directors, employees, contractors, founders (including Dr. Mark Weyers), and affiliates (“Released Parties”) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for personal injury, loss of profits, loss of data, or loss of goodwill, arising out of or related to the Site, the Products, or these Terms.
- The aggregate liability of the Released Parties for any claim arising under these Terms or out of the purchase or use of any Product is limited to the amount actually paid by Customer to Evolve for the specific Product giving rise to the claim, in the twelve (12) months preceding the claim.
- Customer acknowledges that, because the Products are sold for research use only and not for human consumption, any personal injury arising from off-label or self-administered use is the sole responsibility of Customer.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so some of the above limitations may not apply.
13
Indemnification
Customer agrees to defend, indemnify, and hold harmless Evolve and the Released Parties from and against any claim, demand, suit, regulatory action, or proceeding — and any associated losses, damages, liabilities, settlements, judgments, costs, and reasonable legal fees — arising out of or related to:
- (a) Customer's breach of these Terms, including the representations in Section 4;
- (b) Customer's use, misuse, handling, storage, disposal, or transfer of any Product;
- (c) Any injury to Customer or to any third party arising out of Customer's off-label or human use of the Products contrary to Section 3;
- (d) Customer's violation of any law or regulation, including import restrictions in Customer's jurisdiction;
- (e) Customer's infringement of the intellectual property rights of Evolve or any third party.
14
Disclaimer of Warranties
Except for the limited Product-defect window described in the Refund Policy, the Products and the Site are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, statutory, or otherwise. Evolve specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
15
Force Majeure
Neither party shall be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, pandemic, war, terrorism, riot, civil unrest, government action, regulatory change (including but not limited to new Health Canada restrictions), customs seizures, carrier failure, power or internet outage, or laboratory failure.
16
Termination
Evolve may suspend or terminate Customer’s access to the Site at any time, with or without notice, for any reason including violation of these Terms. Termination does not waive any rights or obligations accrued prior to termination, including Sections 3, 9, 10, 12, 13, 14, 17, and 18, which survive termination.
17
Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Customer and Evolve agree to submit to the exclusive jurisdiction of the courts of Toronto, Ontario, for any dispute arising under or related to these Terms.
Note on hosting: Evolve’s Site infrastructure is hosted in Finland (Hetzner Online GmbH data centre, Helsinki). Hosting location does not alter the governing-law election in this Section. Customers in the European Economic Area retain non-waivable consumer-protection rights under applicable EU law; nothing in these Terms displaces those rights where they cannot lawfully be waived.
18
Changes to these Terms
Evolve may update these Terms at any time. The “Last updated” date at the top reflects the most recent revision. Material changes will be posted on the Site and, where reasonably practicable, communicated by email to registered customers. Continued use of the Site after a revision constitutes acceptance of the revised Terms.
19
Severability
If any provision of these Terms is held unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to render it enforceable.
20
Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, and any order-specific terms displayed at checkout, constitute the entire agreement between Customer and Evolve with respect to the Site and the Products, and supersede any prior agreement or understanding.
